Terms of Service

Returns – Upon proper notification and authorization, STOMSKI RACING LC accepts returns on new and unused parts within 30 days of sale.  Any return may be subject to a restocking fee at STOMSKI RACING LC’s discretion. No returns will be accepted after 30 days from the date of sale. In order for STOMSKI RACING LC to accept a returned item, the item must be included in its original packaging, must have original manufacturer information, must not have been used, installed nor disassembled, must not be damaged, marked, nor scratched, and must not have any missing parts or components.  Please note that TOOLS are not returnable.

You must notify STOMSKI RACING LC prior to returning any item - any unauthorized return will be refused and sent back to you at your cost. Please ensure that any returned item is securely and properly packaged in order to prevent any damage in transit.  STOMSKI RACING LC strongly suggests that you insure your return shipment against loss/damage with your shipping company and obtain proof of shipping (tracking numbers etc.).  If the returned item is damaged in transit, STOMSKI RACING LC may decline a refund and/or return the item to you in lieu of a refund.

Disclaimer of Warranties- Vehicle racing and/or modification is inherently dangerous with significant risk of personal injury or even death. When a user participates in vehicle racing and/or vehicle modification, the user accepts the risk inherent therein. STOMSKI RACING LC makes no warranty that the use of STOMSKI RACING LC products or parts or any part they sell guarantees personal safety or freedom from physical injury or operates as a life saving device.

ALL STOMSKI RACING LC PRODUCTS AND PARTS ARE SOLD “AS IS” WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES WHATSOEVER.

EXPRESS WARRANTIES, IMPLIED WARRANTIES, WARRANTIES OF MERCHANTABILITY AND WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE ARE EXCLUDED.

THE ENTIRE RISK OF QUALITY AND PERFORMANCE OF ANY PRODUCT OR PART SOLD BY STOMSKI RACING LC IS WITH THE BUYER-USER, SUBSEQUENT USER, OR AGENT THEREOF (COLLECTIVELY REFERRED TO HEREIN AS “USER”).

SHOULD ANY PRODUCT OR PART SOLD BY STOMSKI RACING LC PROVE DEFECTIVE FOLLOWING THE PURCHASE THEREOF, THE BUYER AND NOT THE MANUFACTURE(S), DISTRIBUTOR(S), OR RETAILER(S), ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICES OR REPAIR.

STOMSKI RACING LC disclaims all liability for any special, direct, incidental or consequential damages, or any damages whatsoever, including, without limitation, the loss of life or limb, or damages due to bodily or personal injury, which may arise or result from the sale, installation, or use of any of its products and parts.

It is the user’s responsibility to inspect and verify the dimensions, specifications, and performance of all products and parts sold by STOMSKI RACING LC as being appropriate for the use to which the user will put them prior to any actual installation and/or use of said products and parts.

STOMSKI RACING LC’s products and parts are to be inspected by the user before each use for evidence of damage, defect, or wear. Any deviation by the user from the manufacturer’s specifications concerning use, maintenance, repair, alterations and modifications constitutes willful negligence.

The installation of STOMSKI RACING LC products or parts or any parts or products sold by STOMSKI RACING LC may adversely affect other vehicle components, safety equipment or manufactured goods (collectively “goods”). STOMSKI RACING LC assumes no responsibility for any damage to other goods, or bodily injury that may arise due to failure of other goods, due to installation and/or use, either proper or improper, of STOMSKI RACING LC products or parts.

The liability of STOMSKI RACING LC is limited to the replacement of defective products or parts found under examination by manufacturer to be defective in material or workmanship WITHIN SIXTY (60) DAYS AFTER PURCHASE, and which damage or defect has not been caused by an accident, improper use, alteration, tampering, excessive use, misuse, modification or abuse. The damage of the user shall be deemed liquidated in the costs of replacement of the product or part by STOMSKI RACING LC.

STOMSKI RACING LC assumes no responsibility for errors, omissions, diagrams, pictures, illustrations or text in instructions, documentation, videos, or any other associated information with any STOMSKI RACING LC product or part or any part they sell.

By purchasing or using any product sold through or by STOMSKI RACING LC, the user agrees that if any provision of this Disclaimer is held to be illegal, invalid or unenforceable under present or future law, such provision shall be fully severed from the Disclaimer and this Disclaimer shall be construed and enforced as if such illegal, invalid or unenforceable provision never comprised a part hereof, and the remaining provisions hereof shall remain in full force and effect and shall not be affected by the illegal, invalid, or unenforceable provision, there shall be added automatically as part of this Disclaimer a provision as similar in its terms to such illegal, invalid or unenforceable provision as may be possible and be legal, valid and enforceable.

By using and/or purchasing any STOMSKI RACING LC product or part or any part they sell, user/purchaser understand and agree to the foregoing Disclaimer of Warranties.
